HRA Exemption Frequently Asked Questions (Section 10(13A))

Can I claim HRA under the New Tax Regime (Section 115BAC)? +
No. HRA exemption under Section 10(13A) is strictly available only if you choose to file your return under the Old Tax Regime. The New Tax Regime disallows almost all itemized exemptions (including HRA, LTA, and Section 80C deductions) in exchange for concessional tax slabs and an increased Standard Deduction of ₹75,000. Use our Old vs New Regime calculator to verify if giving up HRA is mathematically offset by the lower New Regime rates.
Which cities qualify for the 50% Basic Salary metro limit? +
Under Rule 2A of Income Tax Rules, only four municipal cities qualify for the 50% of Basic Salary threshold: Mumbai, Delhi (NCR excludes Gurgaon/Noida per strict tax precedent), Kolkata, and Chennai. For all other cities in India — including Bengaluru, Hyderabad, Pune, Ahmedabad, and Gurgaon — the maximum exemption limit is capped at 40% of Basic Salary.
Can I pay rent to my parents and claim HRA legally? +
Yes, absolutely. You can pay rent to your parents provided: (1) Your parents are the legal registered owners of the residential property, (2) Rent is transferred via verifiable banking channels (NEFT/UPI), (3) You maintain signed rent receipts and a registered rental agreement, and (4) Your parents declare the rental income in their personal Income Tax Returns (ITR) under "Income from House Property". Note: You cannot pay rent to your spouse.
